Been done speeding

Post by 80s kid »

So after 2 years in my van and nesrly 8 years in total my luck has run out and been caught doin 52mph where the road works are on the A14 to Kettering. Its normaly a 70 but is down to 40 and as usual no1 was working at 5.48 in the morning.

So had a letter sent to me today to fill in to see if I was the driver. What happens next?

could do without points tbh so I'm hoping I can go to one of those speed awareness courses and pay a fine

Usually, you confirm or deny stewardship of the vehicle at the time of the offence, and i think its now either 3pts and a fine (most often £200 iirc) OR you take a speed awareness course, which costs more than the fine.

If you don't want the points, take the course. Pretty sure theyre held in Milton Keynes (J14 M1).

Hi mate,

Sorry to hear that fella. Easily done at that time of the morning.

Reckon you are bound to get the option of that speed awareness course rather than the points. My sister-in-law got done twice in a short period of time and both times she got the option to take the course, not the points.

"OUCH" ! I did not realise the course cost more than the fine...but if you don't want the points they have you by the balls fella...

OK 1st is this scam? contact the bacon to find out.
if its genuine they should have already sent you evidence such as a photo from the cameras

right after that is a case of accept it and hope for the course oppose to the points and fine.

OR

you have the right before admitting any guilt to see any and all evidence (including what should have been sent already)
I'd ask for the proof that the cameras are correctly set-up and that the person(s) who set-up and maintains are fully up-to-date with the necessary courses and testing to do this job.

you do have about a month to admit guilt.

If any evidence is out of place and is not 100% they have NO case against you.

to quote a friend of mine got done for doing 42 in a 40 by a mobile van
I told her to write to the chief and ask for the vans reg number, operators name, his/her training and the equipments paperwork.

And finally to end it with what happened to the 12% allowance for calibration error.
needs to say she didn't pay a fine or get points or attend a course and I got a "thank you" out of it.

was very useful to know people in the traffic unit.

but serious don't take it lying down at least get some legal advice.

Nick,
The course costs between £60 and £100, depending on which part of the country you were caught in. Some constabularies don't even offer the speed awareness course as an alternative to points.

I didnt have a photo either with my official letter.

I seem to remember that, GMP at least, you had to put the reference No. off letter + some other info onto their website and that gave you access to the photo.
I suspect most people know they`ve done it, hold their hands up, & pay?

(TBH, and this is just my view, I took the fine & points. I`ve got decades of accident free driving, including large vehicles, the thought of being lumped together with a room full of chavs who`ve been tearing around in their black Corsas, being `made aware` of hazards....Nah!)

If you've done wrong, fess up and take it like a man. Sure, if there's some injustice, or reasonable doubt, don't stand for it, but if you're in the wrong, hold your hands up and admit it.

Hi 80's Kid,

I really hate to be the potential bearer of Bad News, but!!! Not all Insurance Companies will recognize the fact that a Speed Awareness course is different to Points. Yes, they are NOT Points but some say if you've been caught speeding, your just as likely to make a claim for a speed related incident.
This is TOTALLY against everything the Police and the people holding the Course will say, as quite rightly they say, when you attend one of these courses, you should be a SAFER driver and therefore not be penalized by your Insurance after attending. But this is not the case in reality, there is one main Insurer at the moment I know of who do this, I won't slander my-self, I'll just say have a quick read of this article, there are plenty more out there,

http://www.octagoninsurance.com/insuran ... s-courses/

http://www.bbc.co.uk/news/uk-20328860

The BBC link is an older one, but still names and shames!!!

Also if you're with this Insurer, you could be stuck with them for the 5 years they hold a ref of this Speed Awareness course, as I said earlier, not all Insurance Companies do this 'Back Stabbing', but their system might not recognize what this is and you could be declined insurance, which could be worse!!!

Might be better to check up with who your with, 'Covertly' then decide if it's worth taking or accepting the Points...

As I say, this news is Last Year, but I'm not sure how this has preceded recently, if any changes have been made, or the Insurance Co's in question have been told to stop this practice. But I would say definitely worth checking, unless anyone on here knows how this has gone???

Hope what ever route you take, it all works out in the end for you, best of Luck with it all,

John...

John,
That's cheered us all up! I guess the speed awareness course is not the 'get out of jail free' card that we were hoping it was. The websites you have linked to make interesting reading, and it looks like the insurance companies will do everything they can to get an increased premium off their customers.
Of course, those of us with a standard car policy and a classic policy potentially stand to loose out twice.

Andrew.
